Terms of Service
1. Who we are
Place in 72 (“the Desk,” “we,” “us”) is operated by [LEGAL ENTITY NAME], an [Illinois limited liability company], [BUSINESS ADDRESS]. You can reach us at desk@placein72.com or +16307553361.
2. What we do
- We collect the facts you give us about the person who needs care (online or by phone with our automated assistant).
- We phone senior-living communities that fit those facts and ask about availability, prices, fees, the next rate increase, what would make a resident have to leave, Medicaid, staffing, and whether they can hold an opening.
- We look up each community’s licence and, where the state publishes them, its inspection records.
- We write a report that shows, on every line, whether the information was told to us by phone (with the date, time and the person’s name where given), comes from a state record, or comes from public reviews.
- A named advisor reviews every report before it is sent. On the Placement and Guided tiers we arrange tours at times you give us and you can text your advisor for 30 days.
3. What we do not do
- We do not give medical, clinical, legal, tax or financial advice. We are not a health-care provider, a licensed care manager or a social worker. Whether a person needs a given level of care is decided by their doctors and by each community’s own assessment.
- We do not own or operate any community, and we do not promise that a community will admit anyone, keep an opening, charge the price it quoted after its own assessment, or provide good care.
- We do not accept referral fees, commissions or any other payment from senior-living communities. You are our only customer.
- We do not give your name, phone number or email to a community until you tell us to (for example, to book a tour).
4. Tiers and prices
| Tier | Price | What you get |
|---|---|---|
| Price Check | $199, charged only when delivered | Up to 8 communities you name: availability and all-in price confirmed by phone, plus licence and inspection record. No shortlist, no tours. |
| Placement | $495, charged only when delivered | Three verified, available options with prices in writing, state record, reviews and fit notes; tours arranged; your advisor by text for 30 days. An advisor call can be added for $150. |
| Guided | $995, charged only when delivered | Everything in Placement with five options, a 30-minute advisor call, negotiation notes, and a second shortlist if the first falls through. |
| Care Desk | $199 per month, cancel anytime | Monthly check-in, rate-increase and bill review, our first call when anything changes, priority re-placement. Offered after delivery; never required. |
5. Pay on delivery and our guarantee
You save a card with our payment processor, Stripe, when you start. Nothing is charged then. We charge the price of your tier when we deliver your report by text or email. The delivery window starts when your card is saved.
Placement and Guided: Three verified, available options inside 72 hours or you pay nothing. If a confirmed opening turns out not to exist, we refund you.
Price Check: Confirmed prices inside 24 hours or you pay nothing.
If we do not deliver inside the window, you are not charged, and we will send you what we found at no cost.
6. Refunds
- Opening not real. If, within [14] days after delivery, a community in your report tells you that an opening we reported as confirmed was not available on the date we confirmed it, tell us and we refund your fee in full.
- Report incomplete. If your report does not contain what your tier promises, we refund your fee in full.
- Refunds go back to the card you used, within [5] business days of our decision.
- Prices are what each community told us on the date shown. A community may later change its prices or assess a different care level; that alone is not a reason for a refund. [Counsel: confirm the refund rule and the window.]
7. Care Desk subscription
If you choose the Care Desk, you authorise us to charge $199 on the day you start and on the same day each month after that until you cancel. You can cancel at any time by texting or emailing your advisor; cancellation stops all future charges and takes effect at the end of the month you have paid for. We will remind you of these terms in the receipt for your first payment. [Counsel: Illinois Automatic Contract Renewal Act disclosure and cancellation requirements — Unverified, confirm the current text; and any federal negative-option rules.]
8. Calls we make for you
You authorise us to phone senior-living communities on your behalf using an automated assistant. The assistant says it is automated at the start of every call. To get useful answers it shares the person’s first name or a general description, age range, care needs, budget range, move-in timing and area — not your name or contact details unless you tell us to.
9. Text messages
By agreeing to texts you consent to receive text messages from Place in 72 at the number you gave us about your request: your card link, updates, your report, and check-ins at 7 and 30 days, which may mention the Care Desk. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to opt out at any time. Carriers are not liable for delayed or undelivered messages. We do not share your mobile number or your consent with anyone for their marketing. [Counsel: whether the day-7 Care Desk mention needs a separate, optional consent.]
10. Recording and transcripts
Calls with our automated assistant are not recorded unless the assistant tells you at the start of the call that it is being recorded. The assistant keeps a written transcript of what is said so that we get your details right; you can ask us to delete it. [Counsel: Illinois is an all-party-consent state for recording (720 ILCS 5/14) — Unverified, statute not re-read; confirm whether an automated transcript is a “recording” and what notice is needed, for families and for the communities we call.]
11. Where the information in your report comes from
Availability and prices are what a community told us by phone on the date and time shown. Licence and inspection information is from the state’s records on the date shown. Reviews are public reviews, summarised. We check what we can, but we cannot guarantee what a community or a public source tells us. Please visit, read the community’s own contract, and ask the questions in your report before you sign anything.
12. Where we work
We serve families in the United States except the State of Washington. Families in Texas, Arizona and Georgia receive an additional written disclosure about how we are paid before they save a card.
13. Limitation of liability
[PLACEHOLDER — counsel to draft. Working position: our total liability for any claim is limited to the fees you paid us for the case the claim relates to.]
14. Governing law and disputes
[PLACEHOLDER — counsel to draft. Working position: Illinois law; courts in [Cook / DuPage] County, Illinois.]
15. Changes
We may update these terms. The version that applies to your case is the one you accepted, shown by its version date. We will tell you before any change that affects a case in progress.
